Terms of Service

Aliq Studio is a creative agency based in Kuala Lumpur, Malaysia. We provide branding, content creation, social media management, advertising and related creative and marketing services to businesses.

The Site is an informational website that describes our services and lets you contact us. Nothing on the Site constitutes a binding offer. Descriptions of services, processes, pricing indications and timelines on the Site are for general information only and may change without notice.

Any services we provide to you are governed by the specific proposal, quotation, engagement letter or service agreement agreed between you and us in writing (each, an "Engagement Agreement"). If there is any inconsistency between these Terms and an Engagement Agreement, the Engagement Agreement prevails for that engagement.

• Submitting an enquiry through the Site or contacting us does not create a client relationship or any obligation on us to provide services;
• Fees, deliverables, timelines, revision rounds and payment terms are as set out in the applicable Engagement Agreement or quotation;
• Unless stated otherwise, quoted fees are exclusive of any applicable taxes;
• Marketing and advertising outcomes depend on many factors outside our control. We do not guarantee any particular commercial result, ranking, reach, engagement or sales outcome.

You agree that you will not:

• Use the Site for any unlawful purpose or in breach of any applicable law or regulation;
• Attempt to gain unauthorised access to the Site, its servers, or any connected systems or data;
• Interfere with or disrupt the operation of the Site, including by introducing malicious code or placing an unreasonable load on our infrastructure;
• Scrape, harvest, copy or republish content from the Site at scale without our prior written consent;
• Submit false, misleading or fraudulent information through our enquiry form or other channels.

The Site and its content, including text, graphics, logos, images, videos, page designs and underlying code, are owned by or licensed to us and are protected by copyright, trademark and other intellectual property laws of Malaysia and other jurisdictions.

Client work shown on the Site, including portfolio pieces and testimonials, is displayed with the relevant client's permission and remains subject to the rights of the respective owners.

We grant you a limited, non-exclusive, non-transferable licence to view the Site for your personal or internal business purposes. No other rights are granted. You may not reproduce, distribute, modify or create derivative works from any part of the Site without our prior written consent.

As part of delivering our services, we operate internal software applications that connect to third-party platforms, including Google services such as the Google Ads API and Meta advertising services. These applications are used only by our team to manage, report on and optimise advertising campaigns for our own accounts and for clients who have authorised us to manage their advertising. They are not offered to, and may not be accessed by, the public.

Our use of these platforms is subject to the applicable platform terms, including the Google APIs Terms of Service and the Google Ads API Terms and Conditions. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. Our collection, use and disclosure of personal data in connection with the Site and our services is described in our Privacy Policy, which forms part of these Terms. By using the Site you also acknowledge the practices described in the Privacy Policy.

The Site may contain links to third-party websites, platforms and social media profiles that we do not operate or control. We are not responsible for the content, terms or practices of any third party. Your use of third-party services is at your own risk and subject to their own terms.

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, about the Site, including as to its availability, accuracy, completeness or fitness for a particular purpose. We may modify, suspend or discontinue any part of the Site at any time without notice.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or any loss of profits, revenue, business, goodwill or data, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such loss.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Site is limited to one hundred Malaysian Ringgit (RM100). Liability in connection with services we provide under an Engagement Agreement is governed by that Engagement Agreement. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Malaysian law.

You agree to indemnify and hold us harmless from and against any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

We may update these Terms from time to time. The latest version will always be published on this page with a revised "Last updated" date. Your continued use of the Site after any change takes effect indicates your acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms are governed by and construed in accordance with the laws of Malaysia, and you agree to submit to the exclusive jurisdiction of the courts of Malaysia.
